Introduction
This Shopper Disclaimer applies to all shoppers (“you”, “your”) who make payments to merchants through the SpectroCoin payment processing services (“SpectroCoin”, “we”, “us”, “our”). By proceeding with a payment through SpectroCoin’s merchant payment gateway, you confirm that you have read, understood, and agreed to the terms set out in this Disclaimer.
1. Nature of the Service
SpectroCoin provides payment processing services that enable merchants to accept crypto assets and other supported payment methods. When you make a payment through a SpectroCoin merchant payment gateway, SpectroCoin acts as the payment processor between you and the merchant. SpectroCoin is not a party to the underlying transaction for goods or services between you and the merchant.
2. Refund Processing
Refunds for goods or services purchased through a SpectroCoin merchant payment gateway are subject to the following conditions:
Refund eligibility, refund timing, cancellations, reversals, and related outcomes may arise from or be affected by (i) the merchant’s refund, return, or cancellation policies, and/or (ii) SpectroCoin’s legal, regulatory, sanctions, AML/CFT, fraud, risk, or internal compliance requirements and/or other relevant policies. Accordingly, SpectroCoin may, where permitted or required, decline, suspend, restrict, delay, cancel, or refund the transaction.
Where a merchant authorises a refund, SpectroCoin will process the refund in accordance with its operational procedures. Refunds may be processed in the original payment currency or in another currency at the merchant's discretion, and the refunded amount may differ from the original payment amount due to exchange rate fluctuations, network fees, or other applicable charges.
Refund processing times may vary depending on the payment method used, blockchain network conditions, and the completion of any required compliance checks. SpectroCoin shall not be held liable for any delays in refund processing, including any delay in, or inability to, process the refund due to your failure to provide requested information, documentation, or other required timely cooperation.
3. Transaction Monitoring and AML/CFT Compliance
SpectroCoin is committed to full compliance with applicable anti-money laundering (“AML”) and counter-terrorism financing (“CFT”) laws, regulations, and international standards. In connection with these obligations:
All transactions processed through SpectroCoin’s payment gateway are subject to automated and manual monitoring for suspicious activity, in accordance with SpectroCoin’s Anti-Money Laundering and Counter Terrorism Financing Policy.
SpectroCoin reserves the right to delay, suspend, or stop any transaction if there are reasonable grounds to suspect that the transaction may be associated with money laundering, terrorism financing, fraud, sanctions evasion, or any other unlawful activity. Such measures may be taken without prior notice to you.
Where required by law, SpectroCoin will report suspicious transactions to the relevant Financial Intelligence Unit or other competent authorities. SpectroCoin may be prohibited from informing you about such reports.
SpectroCoin shall not be held liable for any losses, damages, or inconvenience arising from the delay, suspension, or stoppage of transactions where such occur due to procedures conducted in accordance with its AML/CFT obligations.
4. Sanctions Compliance
SpectroCoin complies with all applicable international, European Union, United Kingdom (including, where applicable, sanctions extended to the Overseas Territories), and other relevant national sanctions regimes. In this regard:
All transactions and parties involved are screened against applicable sanctions lists, including but not limited to those maintained by the European Union, United Kingdom, the United Nations, the United States Office of Foreign Assets Control (OFAC), and other relevant authorities.
Transactions involving persons, entities, or service providers that are designated on any applicable trade, financial, or economic sanctions list will be blocked and reported to the relevant authorities in accordance with applicable law. Where such actions are prohibited by applicable law, funds associated with such transactions will not be processed, returned, or refunded. SpectroCoin may also be restricted or prohibited from informing you of the reasons for such action or from providing further details.
5. Prohibited and Restricted Jurisdictions
SpectroCoin does not provide its services to persons located in, or originating transactions from, Prohibited Jurisdictions as defined in SpectroCoin’s General Terms and Conditions.
Payments originating from jurisdictions designated as prohibited by SpectroCoin, or through service providers located within such jurisdictions, will not be accepted. If such a transaction is identified before processing is complete, it will be handled in accordance with applicable compliance procedures.
Funds received from prohibited or sanctioned jurisdictions, from persons who are citizens, residents, or tax residents of such jurisdictions, or through service providers located within such jurisdictions, will not be processed and may not be returned or refunded. Any refund request relating to such funds will be subject to additional compliance review and verification. SpectroCoin reserves the right to freeze, withhold, or otherwise deal with such funds and take any action required or permitted by applicable law, including reporting to the relevant authorities.
You are solely responsible for ensuring that you are legally permitted to use SpectroCoin’s services, make payments from your jurisdiction, as well as the jurisdiction of the service provider via which you are initiating a payment. By initiating a payment, you represent and warrant that you are not located in, nor are you a citizen, resident, or tax resident of, a Prohibited Jurisdiction, are not transacting through a service provider located in such jurisdiction, and that you are not subject to any applicable sanctions.
6. Collection of Billing Information
SpectroCoin is required to collect your billing details in order to meet regulatory requirements, including customer identification and verification obligations under applicable AML/CFT and payment services regulations. Your personal data is processed and securely stored in accordance with SpectroCoin’s Privacy Policy.
7. Accuracy of Information
By confirming a payment through the SpectroCoin merchant payment gateway, you declare that all information you have provided is accurate and complete. Providing false, misleading, or incomplete information may result in the suspension or termination of your transaction and may be reported to the relevant authorities.
You also represent that you are not using any obfuscation, anonymisation, or other tracing-avoidance methods or services in connection with the transaction, including mixers, tumblers, privacy-enhancing tools, or similar services designed to conceal the source, destination, ownership, or movement of funds, or providers that do not maintain sufficient transparency and verification standards. Where SpectroCoin identifies the use of any such method, provider, or any other elevated compliance risk, SpectroCoin may subject the transaction to enhanced review and may request additional information, documentation, wallet verification, or other cooperation, and may delay, suspend, block, or otherwise restrict the transaction accordingly.
By proceeding, you also acknowledge and agree that SpectroCoin may contact you at the email address you have provided for the purpose of requesting additional information or completing any required compliance verification.
8. Changes to This Disclaimer
SpectroCoin reserves the right to amend this Shopper Disclaimer at any time at its sole discretion. The most recent version will be made available on SpectroCoin’s support portal. Continued use of SpectroCoin’s payment processing services following any amendments constitutes your acceptance of the revised Disclaimer.
